PT Omarco Edusav Produk (Edusav)1. Introduction
PT Omarco EduSav Produk (“Edusav”) is committed to protecting and safeguarding the confidentiality of the Personal Data of every user (the “User”) who accesses and uses the Edusav platform, including but not limited to the mobile application, website, customer service, and other services developed by Edusav from time to time (the “Platform”).
This Privacy Policy is prepared as a form of Edusav's transparency to Users regarding how Edusav obtains, collects, uses, stores, discloses, transfers, and protects Personal Data in accordance with the laws and regulations applicable in the Republic of Indonesia, including but not limited to the Personal Data Protection Law and all of its implementing regulations.
By accessing and/or using the Platform, the User declares that they have read, understood, and agreed to this Privacy Policy, and grants consent to Edusav to process Personal Data as set out in this Privacy Policy.
2. Scope
This Privacy Policy applies to all services, features, content, systems, technology, and interactions available within the Platform, including but not limited to the mobile application, website, electronic communication media, customer service, promotional activities, surveys, and other additional services that may be developed by Edusav in the future.
This policy also applies to all forms of communication between the User and Edusav, whether conducted online or offline, including communication via electronic mail (e-mail), telephone, short messages, social media, customer service, and other channels.
In using the Platform, the User understands and agrees that any Personal Data provided to Edusav will be processed in accordance with the terms of this Privacy Policy.
3. Types of Data Collected
In providing services to Users, Edusav may collect, access, store, and process various types of Personal Data, including but not limited to:
Data Provided by the User: Data provided directly by the User to Edusav, such as full name, email address, phone number, profile photo, identity information, and other information entered when registering an account or using the services.
Data Collected Automatically: When the User accesses the Platform, Edusav's systems may automatically collect technical data such as IP address, approximate location, device type, operating system, activity logs, access times, and usage activity within the Platform.
Transaction Data: Edusav collects information related to transactions carried out through the Platform, including purchase history, transaction value, payment method, payment status, transaction proof, and other information used. Edusav does not store sensitive data such as card numbers or card security codes directly, except as permitted by applicable law and carried out through a legitimate payment service provider.
Data from Third Parties: Edusav may receive data from third parties such as payment service providers, analytics providers, authentication service providers, business partners, or other technology partners as required for the Platform's operations.
Inferred Data: Edusav may also process data in the form of analyses, preference profiles, and interactions generated from the User's activity and use of the Platform in order to improve service quality, user experience, system security, and product development.
Verification Data: where the User participates in a Promotion or is selected as a winner, Edusav may collect identity documents, tax identification details, proof of address, bank account details for the payment of prizes, photographs and recordings taken at an award event, and any further information required by Edusav or by any authority for verification, anti money laundering or taxation purposes.
4. Purposes of Data Use
Personal Data is used for various purposes, including to provide services to Users, process transactions, provide customer support, manage User accounts, and improve the quality and features of the Platform. In addition, data is also used for internal analysis, product development, prevention of illegal or fraudulent activity, and fulfillment of legal obligations.
Edusav may also use Personal Data in aggregated or anonymized form for statistical, research, and business development purposes without directly identifying the User.
Personal Data is also processed for the following purposes: to administer Promotions, verify eligibility, identify and verify winners, arrange and record award events, and publish results as required by Applicable Laws and by the permit under which a Promotion is operated; to carry out identity verification, know your customer, anti money laundering, counter terrorist financing and sanctions screening checks, whether required of Edusav or of any company within the Edusav group of companies in any jurisdiction in which such a company is established or regulated; to enable Edusav's parent company, subsidiaries and affiliates to meet their own legal, regulatory, accounting, audit, tax and reporting obligations, including in connection with any listing of securities on a recognised stock exchange; and to establish, exercise or defend legal claims, and to respond to requests from governmental, regulatory, tax or law enforcement authorities.
Personal Data is also processed in connection with intra-group commercial arrangements. Edusav is provided with intellectual property, software, technology, management services and financing by companies within its group, and is charged for those services and for the use of those assets. Transaction, sales volume and customer activity data is processed in order to calculate, invoice, substantiate and audit those charges, to prepare and maintain the transfer pricing documentation required under Applicable Laws, and to satisfy the group's tax, accounting and audit obligations in Indonesia and in the jurisdictions in which other group companies are established.
Where amounts are remitted outside the Republic of Indonesia in settlement of such charges, Edusav and the receiving company may additionally be required to demonstrate the origin of those funds - that is, that the revenues from which the payment is made arose from genuine sales of Products and Services to genuine customers. That requirement may be imposed by banks and correspondent banks, by payment service providers, by tax authorities, by auditors, by regulators, or by the rules of any exchange on which securities of a group company are listed or proposed to be listed, and it may fall on the receiving company rather than on Edusav. Edusav uses aggregated or anonymised data for all of the purposes described in this paragraph wherever that is sufficient, and processes Personal Data only to the extent necessary. The User acknowledges that such necessity may include the provision of customer-level detail where aggregated data will not satisfy the requirement.
5. Cookies
Edusav uses cookies and similar technologies to enhance the User experience. These technologies enable Edusav to remember preferences, understand usage behavior, and deliver more relevant content. Users may configure or disable the use of cookies through their respective browser settings; however, doing so may affect certain functions, performance, or conveniences of the Platform.
6. Disclosure of Personal Data
In carrying out its services, Edusav may disclose Personal Data to third parties that cooperate with Edusav, such as technology service providers, payment providers, professional consultants, auditors, and other business partners. Disclosure may also be made where required by law or in the context of legal proceedings. In the event of a merger, acquisition, or restructuring, Personal Data may be transferred as part of the company's assets.
Edusav may also disclose Personal Data to its parent company, subsidiaries and affiliates, and to their professional advisers, auditors, regulators and prospective investors, for the purposes set out in Article 4, subject to appropriate confidentiality and security arrangements.
Edusav may provide access to or copies of Personal Data to third parties only to the extent necessary for legitimate processing purposes and in accordance with the applicable cooperation relationship. Such third parties are obliged to maintain the confidentiality and security of Personal Data and are prohibited from using Personal Data for any purpose other than that determined by Edusav.
Edusav may also set time limits on the storage, use, or access of Personal Data provided to third parties. Once the processing purpose has ended or the specified period has expired, third parties are obliged to delete, destroy, return, or anonymize the Personal Data in accordance with Edusav's instructions and applicable laws and regulations.
7. International Transfers
The User's Personal Data may be processed, stored, accessed or transferred outside the territory of the Republic of Indonesia, including by Edusav's parent company, subsidiaries and affiliates, and by third parties that co-operate with Edusav, for any of the purposes set out in Article 4 of this Privacy Policy.
Where Personal Data is transferred outside the Republic of Indonesia, Edusav will ensure that one of the following applies: the receiving country or international organisation provides a level of Personal Data protection equal to or higher than that provided under the laws of the Republic of Indonesia; or appropriate and binding safeguards are in place between Edusav and the recipient; or the User has given consent to the transfer.
By accessing or using the Platform, and in particular by participating in any Promotion, the User consents to the transfer of their Personal Data outside the Republic of Indonesia for the purposes set out in Article 4, including for identity verification, anti money laundering and regulatory reporting purposes.
Edusav will take the steps reasonably necessary to ensure the security and confidentiality of Personal Data during any international transfer.
8. Data Storage and Retention
Edusav stores the User's Personal Data only for as long as necessary to fulfill the purposes of collecting and processing Personal Data, as set out in this Privacy Policy, including for service provision, fulfillment of legal obligations, dispute resolution, conducting audits, enforcement of rights and obligations, and legitimate business interests. Once no longer needed, Personal Data will be deleted, destroyed, or anonymized in accordance with applicable law and Edusav's internal policies.
9. Data Security
Edusav implements reasonable technical, administrative, and organizational measures to protect the User's Personal Data from unauthorized access, unlawful use, alteration, disclosure, loss, misuse, or other damage to Personal Data. Such protective measures include the use of encryption, firewalls, internal access restrictions, authentication systems, and other security procedures deemed necessary by Edusav. However, the User understands that no system is entirely secure and free from risk.
10. User Rights
In accordance with applicable law, the User has rights over their Personal Data, including but not limited to the right to obtain information, access, correct, update, or delete Personal Data, as well as the right to withdraw consent to data processing. The User is also entitled to raise objections or complaints regarding the use of Personal Data.
Edusav reserves the right to verify the User's identity before processing any request relating to Personal Data.
11. Account Deletion
The User may submit a request to delete their account and certain Personal Data through the features available within the Platform or by contacting Edusav's customer service.
Edusav may retain certain Personal Data insofar as required by law, needed for dispute resolution, fraud prevention, audits, law enforcement, or other legitimate interests.
Upon receiving a valid account deletion request, the User's account will be disabled for a period of 90 (ninety) days. During this period, the User will no longer be able to access or use the account. If the User does not request account reactivation within the 90 (ninety) day period, the account will be permanently deleted after 90 (ninety) days and cannot be recovered.
12. Protection of Children
This Platform is not intended for children under 18 (eighteen) years of age without the consent of a parent or legal guardian. Edusav does not intentionally collect, obtain, use, or process children's Personal Data without valid consent from the child's parent and/or guardian.
Where the Personal Data of a child is processed, Edusav may take the necessary steps to verify age and to verify that consent has been validly given by the child's parent and/or guardian, taking into account available technology and applicable law.
Edusav is committed to implementing special protective measures for children's Personal Data to prevent unlawful use, disclosure, or processing that is not in accordance with the purpose of data collection.
If Edusav becomes aware that children's Personal Data has been obtained or processed without valid consent, Edusav reserves the right to take such action as it deems necessary, including ceasing the processing of Personal Data, restricting access to services, and deleting or destroying such Personal Data in accordance with applicable law.
13. Personal Data Breach
In the event of a security breach affecting Personal Data, Edusav will take the necessary steps to identify the cause of the incident, contain its impact, restore systems, and mitigate the impact, as well as notify Users and/or the relevant authorities in accordance with applicable law. Edusav will also conduct internal evaluations to improve its security systems and prevent the recurrence of similar incidents in the future.
14. Third-Party Links
The Platform may contain links, features, or integrations with third-party websites or services that are beyond Edusav's control.
Edusav is not responsible for the privacy policies, data protection practices, or content of such third-party sites or services. Users are advised to read the privacy policy of each third party before providing Personal Data.
15. Changes to the Privacy Policy
Edusav may change, update, or adjust this Privacy Policy from time to time in line with service developments, operational needs, or changes in applicable law.
Any changes will be announced through the Platform and take effect from the date of publication. Users are advised to periodically read and review this Privacy Policy to stay informed of the latest information regarding Edusav's Personal Data protection practices.

This Privacy Policy is made and construed under the laws of the Republic of Indonesia. By accessing and using the Platform, the User declares that they have read, understood, and agreed to all provisions of this Privacy Policy without exception.
This Privacy Policy is prepared in the Indonesian and English languages. In the event of any inconsistency or difference of interpretation between the two versions, the Indonesian version prevails.
